Legal guarantee of conformity (Italy)
This page informs consumers resident in Italy about the legal guarantee of conformity under Articles 128 et seq. of the Italian Consumer Code (Legislative Decree No. 206 of 6 September 2005, as amended by Legislative Decree No. 170 of 4 November 2021). The legal guarantee is free of charge, is granted by law and cannot be excluded or limited.

How long it lasts
- The seller is liable for any lack of conformity that exists at the time of delivery and becomes apparent within two years of delivery (Art. 133).
- A lack of conformity that becomes apparent within one year of delivery is presumed to have existed at the time of delivery, unless proven otherwise (Art. 135).
- Claims for defects not fraudulently concealed by the seller become time-barred 26 months after delivery (Art. 133).
What you can ask for
- Bringing the product into conformity by repair or replacement, at your choice unless the chosen remedy is impossible or disproportionately costly, free of charge, within a reasonable time and without significant inconvenience (Arts. 135-bis and 135-ter).
- If conformity cannot be restored or the repair or replacement fails, a proportionate reduction of the price or termination of the contract (Arts. 135-bis and 135-quater).
How to make a claim
Write to info@evamats.store or by post to EVAMATS Sp. z o.o., ul. Strzelca 42, 80-299 Gdańsk, Poland, stating your order number, a description of the defect and, if possible, photos. We reply without delay and in any case within 14 days. If the product has to be examined, we collect it at our expense.
The legal guarantee applies in addition to the right of withdrawal and does not replace it. More details in the Return and refund policy and in the Terms and conditions.
